			<content:encoded><![CDATA[<p>A reason for annulment is called a diriment impediment to the marriage. Prohibitory impediments (which no longer exist in the Latin Code, CIC83) make entering a marriage wrong but do not invalidate the marriage, such as being betrothed to another person at the time of the wedding; diriment impediments, such as being brother and sister, or being married to another person at the time of the wedding, prevent such a <a title="Marriage in Crisis" href="http://www.savingamarriage.co.uk/marriage-in-crisis" target="_blank">marriage in crisis</a> from being contracted at all. Such unions are called putative marriages.</p>
<p>Diriment impediments include:</p>
<p>- Consanguinity<br />
- Insanity precluding ability to consent<br />
- Not intending, when marrying, to remain faithful to the spouse (simulation of consent)<br />
- One partner had been deceived by the other in order to obtain consent, and if the partner had been aware of the truth, would not have consented to marry<br />
- Abduction of a person, with the intent to compel them to marry (known as raptus), constitutes an impediment as long as they remain in the kidnapper&#8217;s power.<br />
- Failure to adhere to requirements of canon law for marriages, such as clandestinity<br />
- The couple killed the spouse of one of them in order to be free to marry.<br />
- The couple committed adultery.<br />
- The couple were under the influence of alcohol or drugs at the time of the marriage.</p>
<p>Some impediments can be dispensed, in which the Church exempts a couple, prior to the marriage, to the obligation to conform to the canon law. While some relationships cannot have the impediment of consanguity dispensed, a marriage can be sanctioned between cousins. This renders the marriage valid, and so non-annulable. You may in this case require some <a title="online marriage help" href="http://www.savingamarriage.co.uk/online-marriage-help" target="_blank">online marriage help</a>. Again, if an invalid marriage has been contracted, and the diriment impediment can be removed, a convalidation or sanatio in radice can be performed to make the marriage valid.</p>

<h3>MARRIAGE ANNULMENT PROCESS TIMELINE</h3>
<p><strong>1. Introduction stage &#8211; </strong>During this stage the tribunal officials determine the nature of the case, competence and whether the case has merit. This can take approximately two to three months.</p>
<p><strong>2. Collection of testimonies -</strong> Petitioner, respondent and witnesses are all contacted. Sometimes expert witnesses may be contacted. This stage can also take between two &#8211; four months.</p>
<p><strong>3. Publication of the Acts -</strong> If neither of the parties have anything else to add, or their time to do so has expired, then the collection of proofs is considered concluded. The petitioner, respondent, and their advocates, at this time, are permitted, if they so wish, to inspect at the tribunal offices the acts of the case. If either party wishes to propose new proofs they may do so at this time. Also, the advocates, and the defender of the bond present legal arguments to the judge. Traditionally, these arguments are in the form of written legal briefs. This stage can take from one to three months.</p>
<p><strong>4. The Decision of the Judge (s) -</strong> The judge then renders a decision by means of a judicial sentence. The sentence consists of the basic facts of the case, the law and jurisprudence upon which the case is decided, and the argument, which argues the facts of the case in light of the law. Once the sentence is issued by the judge the &#8220;publication of the sentence&#8221; occurs. This stage can take approximately one month.</p>
<p><strong>5. The appeal process.</strong> All affirmative judgments in the Court of First Instance are forwarded or appealed to the next tribunal level, the Court of Second Instance. This stage can take anywhere between two-six months.</p>
<p>If the sentence of the First Instance Court is confirmed by the Judges of the Second Instance court, then the decision is usually final.</p>

<p>What you need to do is let the Church know where your ex-spouse currently stays. You do not have to have anything to do with them.</p>
<p>Your ex-spouse will be sent a letter explaining the process that was initiated. They do not have to agree to the annulment. Whether or not your ex-partner takes part in the process, the annulment will still go ahead regardless.</p>

			<content:encoded><![CDATA[<p>According to <a href="http://en.wikipedia.org/wiki/Catholic_marriage">wikipedia</a>, Catholic Marriage, also known as matrimony, is a &#8220;covenant by which a man and a woman establish between themselves a partnership of the whole of life and which is ordered by its nature to the good of the spouses and the procreation and education of offspring.&#8221;</p>
<p>The couple who wish to enter into a marriage contract must both be free to marry, and to marry each other. They must be an unmarried man and woman, with no impediments as set out by Canon law.</p>
<p>The participants must both also have the intention to marry. In the Catholic Church, consent makes marriage. What this means is both patners must be willing to give thmeselves to each other wholly and of their free will, without any coercion. If these conditions are not met then the the marriage is considered invalid.</p>
<p><strong>What is an Annulment?</strong></p>
<p>An annulment is the process of declaring the marriage as invalid at the time the vows were exchanged. An annulment is declared only when a tribunal finds a lack of validity in the marriage at the time of the marital contract.</p>
<p>A marriage would be considered invalid if one of the parties, at the time of marriage, did not intend to honor the vow of fidelity. If the spouse did intend to be faithful at the time of the marriage but later committed adultery this does not invalidate the marriage.<br />

Difference Between Annulment and Divorce</strong></p>
<p>Annulment and divorce are different. An annulment is a finding that sacramental marriage never existed, whereas a divorce is a dissolution of marriage.</p>
